Executive Order 14141

Advancing United States Leadership in Artificial Intelligence Infrastructure

This executive order directs federal agencies to identify and lease government land for private-sector construction of frontier AI data centers and associated clean energy facilities by 2027. It establishes competitive solicitation processes, mandates clean power procurement, imposes security and labor standards, and requires frameworks to ensure national security access to AI capabilities while fostering competitive markets.

Impact dates

  1. Target commence full-capacity operation of AI infrastructure

  2. DOD issue regulations for heightened hardware safeguards

  3. Target begin construction of frontier AI data centers

  4. DOE submit report on AI data center effects on electricity prices

  5. Interior establish geothermal direct-use leasing program with dedicated personnel

  6. Announce winning proposals and develop lease frameworks

  7. DOD/DOE design, launch, and administer competitive solicitations (close within 30 days)

  8. BLM identify sites for clean energy rights-of-way; Interior designate 5+ Priority Geothermal Zones

  9. DOD and DOE each identify minimum 3 federal sites for frontier AI data centers

Key directives

  • DOD and DOE each identify minimum 3 federal sites suitable for frontier AI data centers by Feb 28, 2025
  • BLM identify suitable sites for clean energy rights-of-way by Mar 15, 2025
  • Interior designate at least 5 Priority Geothermal Zones by Mar 15, 2025
  • DOD/DOE launch competitive solicitations closing within 30 days by Mar 31, 2025
  • Announce winning proposals by Jun 30, 2025
  • Develop lease frameworks allowing private ownership with conditions by Jun 30, 2025
  • Target construction start Jan 1, 2026 and full operation by Dec 31, 2027
  • Require concurrent clean power procurement matching hourly demand
  • Require NIST/AISI security standards adherence and MOU for model evaluation
  • Require access to models for national security at market rates
  • Reserve non-training compute for startups/small firms
  • Require US-fabricated leading-edge semiconductors to maximum practicable extent

  • DOD regulations on hardware safeguards within 1 year
  • Geothermal leasing program within 180 days
  • Annual review cycle for security regulations ongoing

Risks & tensions

  • Vague 'as appropriate' and 'to the extent consistent' qualifiers throughout may limit enforcement; 'if possible' on site identification weakens obligation
  • Competition between rapid deployment (2025-2027 targets) and thorough environmental/community review
  • Tension between national security access requirements and proprietary AI model protection
  • Potential conflict between clean energy mandates and grid reliability/timeliness
  • Small-firm set-aside (at least one consortium) may conflict with scale requirements for frontier AI infrastructure
  • Cost-shifting to non-Federal parties for transmission, environmental review, and decommissioning may deter bids or raise consumer costs despite stated intent
  • Unclear how 'hourly matching' of clean power will be verified or enforced
  • Interplay with CHIPS Act domestic semiconductor goals may create supply constraints
