  • Modify HTS to conform to Convention amendments and establish additional subordinate tariff categories (Annex II)
  • Continue staged duty reductions in Rates of Duty 1-General subcolumn for goods entered on or after dates in Annex III section A

Timeline

Immediate

  • Proclamation signed December 11, 1995
  • Federal Register publication December 15, 1995

Near term (90d)

  • HTS modifications under Annexes I and II effective on later of January 1, 1996 or 15 days after Federal Register publication (i.e., December 30, 1995)
  • Annex III and IV modifications effective on dates specified in those annexes

Long term

  • Continued staged duty reductions under URAA and NAFTA Implementation Act for affected tariff provisions

Risks & tensions

  • Complex interdependence of annexes creates compliance tracking burden for importers
  • Dual-trigger effective date (later of Jan 1, 1996 or 15 days post-publication) may create brief uncertainty for entries between Dec 30, 1995 and Jan 1, 1996
  • Rules of origin modifications could disrupt existing supply chain certifications
  • Technical corrections to Proclamation 6763 suggest prior implementation errors may have affected duty assessments
