Risks & tensions

  • Retaliation risk from India against US exports explicitly anticipated in Sec. 4(b)
  • Potential WTO challenge to IEEPA-based tariff on non-Russian country
  • Circular enforcement problem: tracing 'indirect' Russian oil imports through intermediaries (Sec. 7(b))
  • Stacking with EO 14257 reciprocal tariffs creates compounded trade barriers
  • Sec. 3(a) carve-out for section 232 actions creates complexity but avoids triple-stacking for steel/aluminum/autos
  • Vague 'indirectly importing' standard leaves significant discretion to Secretary of Commerce
