Executive Order 13358

Assignment of Functions Relating to Certain Appointments, Promotions, and Commissions in the Armed Forces

This executive order delegates certain presidential authority over military appointments, promotions, and commissions to the Secretary of Defense (for most armed forces) and the Secretary of Homeland Security (for the Coast Guard when not operating under the Navy). The delegations exclude high-ranking officer promotions at the brigadier general/rear admiral level and above, which remain presidential prerogatives.

Key directives

  • Secretary of Defense assumes presidential functions under 10 U.S.C. §§ 1521(a), 12203(a), 14111(a), 14310(a) for non-Coast Guard services
  • Secretary of Homeland Security assumes parallel functions for Coast Guard (non-Navy period) under 10 U.S.C. and 14 U.S.C. provisions
  • High-grade exceptions preserved: presidential retention of authority for brigadier general/rear admiral (lower half) and above
  • Reassignment permitted to Senate-confirmed civilian officers within respective departments, with specific restrictions on 10 U.S.C. § 12203(a) and § 14111(a) functions

Timeline

Immediate

  • EO takes effect October 1, 2004

Near term (90d)

  • Secretaries may establish internal reassignment protocols for delegated functions

Long term

  • Ongoing streamlined promotion and appointment processes for non-flag officers
  • Continued presidential control over general/flag officer promotions

Risks & tensions

  • Potential tension between streamlined delegation and presidential command authority, though Sec. 4(b) explicitly preserves Commander in Chief powers
  • Bifurcated Coast Guard authority depending on Navy operational status creates administrative complexity
  • Reassignment restrictions to Senate-confirmed officers maintain civilian control but may slow decision-making
