Executive Order 13206

Termination of Emergency Authority for Certain Export Controls

This executive order revokes Executive Order 12924 and rescinds the declaration of economic emergency that had kept export control regulations in effect under the International Emergency Economic Powers Act (IEEPA). However, all existing export control rules, regulations, and administrative actions remain in force under the newly reauthorized Export Administration Act of 1979 or other appropriate authority.

Key directives

  • Revoke Executive Order 12924 of August 19, 1994
  • Rescind declaration of economic emergency
  • Preserve all existing export control regulations, rules, licenses, and administrative actions as if issued under the Export Administration Act of 1979 or other appropriate authority
  • Preserve IEEPA-based rules relating to section 38(e) of the Arms Export Control Act until amended or revoked

Timeline

Immediate

  • Revocation of EO 12924
  • Rescission of economic emergency declaration
  • All existing export control regulations remain in force under new statutory authority

Near term (90d)

Long term

  • Continued operation of export control system under reauthorized Export Administration Act rather than emergency authority

Risks & tensions

  • Legal continuity risk: Transition from emergency to statutory authority creates potential litigation over validity of existing regulations
  • Regulatory overlap: Preservation of IEEPA-based rules for Arms Export Control Act matters alongside other authorities may create administrative complexity
  • No explicit sunset for preserved rules: Regulations remain until actively amended or revoked by 'proper authority,' leaving timing uncertain
