Facilitation of a Presidential Transition
This executive order establishes a Presidential Transition Coordinating Council to facilitate the 2008-2009 presidential transition, requiring federal agencies to prepare briefing materials, coordinate orientation activities, and provide information equally to major party candidates. It supersedes the previous transition EO from 2000 and automatically expires on February 20, 2009 unless extended.
Homeland Security Information Sharing
This executive order delegates presidential functions under the Homeland Security Act of 2002 to the Secretary of Homeland Security, primarily concerning procedures for sharing homeland security information with state and local personnel. It assigns most information-sharing authorities to DHS while reserving certain intelligence and classification functions for the Attorney General and Director of Central Intelligence.
Further Implementation of the Presidential Records Act
This executive order establishes procedures for former and incumbent Presidents to review and assert constitutionally based privileges over Presidential records after the 12-year restricted access period expires. It gives both former and incumbent Presidents veto power over disclosure of privileged records to FOIA requesters, requires the incumbent President to generally concur with the former President's privilege decisions, and replaces the previous Reagan-era framework with a more protective process.
